Photography / Videography Agreement

Agreement Overview:
This Agreement expresses the full and complete agreement between CLIENTS and KATSU NOJIRI PHOTOGRAPHY regarding the services described herein. It supersedes all prior agreements. Any changes or additions to this Agreement must be made in writing and agreed upon by both parties.

Cooperation:
KATSU NOJIRI PHOTOGRAPHY and its associates or employees will be the exclusive photographers/videographers at this event unless otherwise noted. Good faith cooperation and communication between all parties are essential for achieving the best results.

  • CLIENTS must identify key subjects, products, or details they wish to be photographed or filmed.

  • Special requests must be communicated in writing to KATSU NOJIRI PHOTOGRAPHY before the event.

  • KATSU NOJIRI PHOTOGRAPHY will not be held responsible for missed shots due to lack of cooperation, failure to provide instructions, or circumstances beyond its control.

House Rules:
CLIENTS understand that photographers/videographers must adhere to venue guidelines. It is the CLIENTS’ responsibility to negotiate with venue officials if adjustments to these guidelines are required.


Images, Editing, and Copyrights:
All images and videos produced by KATSU NOJIRI PHOTOGRAPHY are protected under copyright law.

  • Usage Rights: Upon final payment, CLIENTS may use images/videos for internal purposes. Commercial distribution, alteration, or reproduction is prohibited without written consent.

  • Editing Policy: Final images include basic editing (e.g., color correction, exposure adjustment). Retouching (e.g., removing tattoos or background items) is not included.

  • Raw Files: Raw images/videos are available as an optional add-on and are not included in standard quotes.

  • Delivery Format: Photography is delivered in JPEG format; videography is delivered in MOV format.

Change Requests:
CLIENTS are entitled to two complimentary rounds of video edits for minor adjustments. Any additional change requests or major revisions will incur a fee. Complimentary edits must be requested within 14 days of delivery. Technical errors will be corrected at no cost. The two complimentary edits are intended to enhance the original video, not to create entirely new content. This may include adjusting the timing of certain shots, modifying background music, or reordering clips for smoother storytelling. If you have specific editing preferences or requests, please communicate them before the event to ensure they are considered during the initial editing process.

Specific Images Disclaimer:
While all efforts will be made to capture key moments, KATSU NOJIRI PHOTOGRAPHY uses a photojournalistic approach and cannot guarantee specific shots. Missing specific images is not grounds for a refund.

Model Release:
CLIENTS grant KATSU NOJIRI PHOTOGRAPHY the right to use images or footage for promotional purposes (e.g., website, Social Media advertising). CLIENTS release KATSU NOJIRI PHOTOGRAPHY from claims related to this usage.

Retainer & Payment Schedule:

  • A non-refundable 50% deposit is required to secure the booking. This deposit applies to the total fee.

  • The remaining balance is due 4 weeks before the event date.

  • Additional hours or services added during the event must be paid before the final delivery of images/videos.

  • In case of cancellation, the deposit will be retained as liquidated damages.

Limit of Liability:
KATSU NOJIRI PHOTOGRAPHY takes utmost care but cannot guarantee that images or footage will not be lost or damaged due to unforeseen circumstances, technical issues, or events beyond its control.

  • In the event of an emergency preventing coverage, a suitable replacement will be arranged, or all payments refunded.

  • Liability is strictly limited to the amount paid under this Agreement.


Limited Warranty:
Faulty soft copies will be replaced within 60 days of delivery. Beyond this period, replacement fees will apply.

Force Majeure Clause:
KATSU NOJIRI PHOTOGRAPHY is not liable for cancellations or delays caused by circumstances beyond its control (e.g., natural disasters, government restrictions).
